Board Director Election Procedure

Qualifications
Must be registered voter residing in Mariposa County (Health and Safety Code Section 32100)
May not be an employee of the District (Government Code Section 53227)
May not be a policymaking employee, director, medical staff officer of, or possess any ownership interest in a hospital deriving more than 5% of its inpatient admissions from residents of the District (Health and Safety Code Section 32110)

PROCEDURE TO FILL A VACANCY ON THE BOARD

Section 32100 of Health & Safety Code (H&S) establishing the hospital district provides that any vacancy upon the board shall be filled pursuant to Government Code (GC) Section 1780.

GC Section 1780 provides the following procedure:
1. The District must provide notice to the County elections official of the vacancy within 15 days of the vacancy.
2. Within 60 days of the date of the vacancy, the remaining board members may either (1) fill the vacancy by appointment or (2) call an election to fill the vacancy. Within the 60 day period immediately after the vacancy occurs, the board has the authority to decide if the board will fill the vacancy by appointment within the 60 day period or if the board will call an election.
3. If the board fills the vacancy by appointment, the board must post a 'notice of vacancy' and provide notice of the date and time of the anticipated action to make the appointment. The notice must be posted in three conspicuous places within the district at least 15 days prior to the Board's action (a notice is published in the Mariposa Gazette).
4. If the board fills the vacancy by appointment, the county elections official must be notified of the appointment within 15 days of the appointment being made. (File Secretary of State Statement of Facts, as well.)
5. If the board members do not take action within the 60 days to either appointment or call an election, then within 90 days of the date of the vacancy the County's Board of Supervisors may (1) fill the vacancy by appointment; or (2) order the district to call an election to fill the vacancy.
6. If the Board of Supervisors fails to make an appointment or take action within the time prescribed, then the District shall call an election to fill the vacancy.
